Quick and Safe Delivery with PayQwick! Seems that my previous blog about delivery services for cannabis got a lot of buzz. Since I wrote the entry word is out in Seattle, Washington that legislation that is on the table permitting only five test retailers that want to offer a weed delivery service is unrealistic. There are more retailers that want to offer delivery service for their customers. PayQwick, a cash management solution that allows retailers the perfect solution for delivery and payment of the product. The delivery guys will not have to worry about having cash on their person. They will accept PayQwick as the preferred method of payment.

Mauricio Braun, PayQwick COO is quoted in TheStranger.com, “We’re ready to go as soon as the law is passed. We’re taking the cash out of the system. The service works by having customers pre-load PayQwick cards with money, keeping the card transaction strictly between users and PayQwick, which, as a non-cannabis-related business, is totally kosher with credit card processors.”

I am all for this method. I use my Starbuck’s APP the same way. I pre-load money and whenever I need a cup of Joe I just use my APP. PayQwick works the same way. It’s easy, efficient and best of all it’s an ideal solution for the delivery game. More and more retailers should and will want to offer this service to their cannabis consumers.

“HB2368”, the legislature that is expected to pass the House, will limit the messenger services to just target their immediate neighborhoods. The local pot shop will just be delivering to their community customers. Just imagine never having to leave the comfort of your home, calling your retailer and in a short while having your friendly delivery guy or gal come knocking at your door. This is not only an ideal situation for the older folk but for all of us ganja users.

PayQwick Connects the Dots for Marijuana and Banking  Since our banks are regulated by the federal government, and since the federal government still classifies marijuana as illegal, business in this exploding industry have serious problems obtaining banking services. At least until now.

PayQwick is the only federally registered and state licensed money transmitter and is currently doing business in Washington state where recreational marijuana is legal.  Licensed by the Department of Financial Institutions, it has shaped its business with strict adherence to the state’s I-502 Compliance program.

Money laundering, illegal payments and criminal activities have always been the concern with tons and tons of cash flowing in every direction.  PayQwick takes the cash out of the system.  By loading a PayQwick card from your bank account, you are able to buy cannabis at retail stores.  The retailer can then in turn use the card to pay growers for product, pay bills or pay for other ancillary services.  Similarly, growers can do the same with their own PayQwick cards.

Cannabis businesses must comply with the Cole memo, written by James Cole, the Assistant U.S. Attorney General in 2013, and the FinCen guidelines (Financial Crimes Enforcement Network) in order to avoid prosecution.  These guidelines insist that profits from this industry come only from legal sales.  PayQwick tracks the money from seed to sale according to Mr. Berke.

Many retail stores in Washington, like High Society in Everett, Washington are using PayQwick as a way to deal with the “overwhelming number of cash transactions”.  Services that they were unable to access have now become available to them.

EMPLOYEES WHO “FIRE-UP” MAY GET FIRED!  Employees who get injured on the job are entitled to compensation for their injuries, their doctor bills and their medications under workers compensation laws.  In New Mexico, if you are prescribed medical marijuana for these injuries, workers compensation will cover that expense because medicinal cannabis is legal in the state.  There is a problem, however.  If that same employee is randomly drug tested and tests positive for marijuana, they can be fired!  How can we reconcile these two things?

Such was the case of Tractor Supply Company’s employee Rojerio Garcia who was ingesting marijuana to help with his symptoms for AIDS.  He was fired because he tested positive for cannabis and filed a lawsuit for wrongful termination.  He lost the lawsuit because he tested positive in a drug test which was part of his contract with the employer despite the fact that there was no evidence of impairment on the job.

It all goes back to the ambiguity between state and federal law and the lack of a standard or a test to measure toxicity in the body.  So long as marijuana remains illegal at the federal level, a federal judge is obligated to follow federal law.  Even though Paul Armentano of NORML has told WorkCompCentral that “ employers should evaluate their drug-testing policies regarding employees’ off-the-job cannabis use to reflect both changing public attitudes as well as the rapidly changing legal landscape”, we all know how hard and how long it takes to change social norms let alone workers compensation laws.

The other issue is that there is no current test for intoxication of cannabis.   Obviously you can’t go to work high or drunk or be impaired while on the job. Marijuana by its nature stays in the body for many days after its consumption so even though you may test positive for the drug, your work performance would not have suffered.

Generally, employers can hire anyone they like regardless of drug use but they cannot discriminate when they do so.  In others words they cannot say that we will only hire one kind of drug use and not another.  Simply stated, it may be wise to check if the company has a drug free policy and if the company tests for drugs.

Over the next several years attorneys will be “fired-up” with plenty of lawsuits that help to reconcile the ambiguities between state and federal laws and state new precedents for marijuana use and the workplace
